What is an Isle of Man Judgment?

An Isle of Man judgment is issued by the Isle of Man Courts of Justice if you fail to repay money owed to a plaintiff, and the plaintiff has taken court action to retrieve the money.

You should receive a court summons explaining the details of a judgment with the opportunity to dispute it. You may not receive the summons if you have moved address and not notified the plaintiff.

Once the judgment has been granted, details are submitted to Registry Trust for inclusion on the public Register. We will contact you by letter using court-provided information to let you know a judgment is due to go on the register.

The Register for Isle of Man contains money judgments submitted in the Isle of Man Courts of Justice.

If the judgment has been recorded in error, you must apply to the Isle of Man Courts of Justice to have the judgment set aside (fee payable) with a sworn affidavit.

If the judgment has been paid in full via the local Coroner’s office, provide proof to the Coroner who will issue a Certificate of Satisfaction (fee applies). Present the certificate to the court so they can notify us to update the Register. If the court notifies us that the judgment was repaid within one calendar month of the original judgment date, the item will be removed from the Register (it remains on court records).

The information appearing on the Register is as follows:

  • Name and address of the defendant the judgment was recorded against
  • Court name and serial number
  • Name and address of defendant
  • Date and amount of judgment (including costs)
  • Details of satisfaction once notified by the General Registry

The Isle of Man Courts of Justice do not provide dates of birth with judgments. The Register only shows the original amount (plus costs) and is not updated for part payments. Plaintiff details are not held on the Register but are available from the General Registry. Judgments remain on the public Register for six years unless cancelled or set aside.

How to Satisfy an Isle of Man Judgment

If you have an IOM judgment registered against you, you need to pay the judgment in full to have it showing as satisfied.

If unpaid, the judgment remains outstanding for six years from the judgment date – we do not hold partial settlement information.

If paid via the local Coroner’s office, provide proof to the Coroner to obtain a Certificate of Satisfaction (fee applies) and present it to the court so they notify us to update the Register. If paid within a calendar month and proof is provided, the judgment can be removed from the Register (though it remains on court records).

If paid after a calendar month, you can apply to have the judgment marked as satisfied by sending proof of payment to Registry Trust.

We require a receipt or original letter from the plaintiff stating:

  • The name and address of the defendant the judgment was recorded against
  • Case number / serial number
  • Court name
  • Amount
  • Date paid in full

We may need to contact the plaintiff if proof is insufficient. Judgments marked as satisfied remain on the public Register for six years; marking as satisfied may improve access to credit.

Removing an IOM Judgment

IOM judgments can only be removed from the Register if they are set aside (fee payable), entered in error, or paid within one calendar month from the judgment date.

Having an IOM Judgment Set Aside

Contact the Isle of Man General Registry to apply to set aside the judgment (approx. £132.50 fee). A sworn affidavit is required (can be prepared at the court public counter for a fee or by an advocate). Court fee details are on courts.im. Once set aside, it is removed from court records and, once notified, from our Register; credit reference agencies are notified.

Judgments paid within a calendar month

If the judgment is paid in full within a calendar month, it can be removed from the public Register. We require a letter from the claimant stating the name and address, serial number, amount, and date paid in full. Judgments issued in error

We will remove IOM judgments issued in error if we receive a letter on letterhead stating the judgment was issued in error, including defendant name/address, serial number, and amount. Do not pay the judgment amount to Registry Trust; we are not the claimants.

Who is the Claimant?

The claimant is the individual or organisation who has taken a money judgment out against you. They may act for themselves or instruct a solicitor to start court action on their behalf.

How do I find out who the Claimant is?

Contact the Isle of Man Courts of Justice and quote the case/serial number. The Court can provide claimant contact information. If you do not know the serial number, you can search on TrustOnline.

I’ve paid the Claimant…now what?

If you paid via the Coroner’s Office, obtain a Certificate of Satisfaction and send it to the Isle of Man Courts of Justice so they can notify us. Alternatively, send proof of payment directly to us.

My Claimant has refused to provide proof of payment – what can I do?

Claimants are under no legal obligation to provide proof once payment has been made. If you provide evidence the debt has been paid, we will attempt to contact the claimant on your behalf. If there is no response after 28 days, the Register may be updated at a manager’s discretion based on the evidence you provide.
